Merton Peterson owned a golf course, a supper club, and the parking lot between them. Both golfers and club patrons always parked in the lot. Peterson sold the club and the lot to the American Legion, which sold them to VBC, Inc. (owned by Richard Beck and others). When VBC demanded rent from Peterson for use of the lot, Peterson filed a suit in a South Dakota state court to determine title.
