My husband after regular physical and mental torture one day tried to murder me but I somehow tried to escape from the situation. My father lodged a GD against him.As we r from the same office, I have to leave the job because of mental torture during the break hours and sometimes in front of my colleagues.Then in consultation with my legal advisor I told him I want divorce in mutual consent. He agreed and the stridhan property except the jewellery was handed over to me. After that he refused to take the petition and instead filed a restitution case against me and I filed for a divorce and alimony case as a counterblast to the restitution suit. Now after refusing the summons twice he accepted the summon. Now my question is that after sending back stridhan property can he claim restitution? Can it be a valid point for us? Can the GD serve as a valid pint for our case?If suppose I lose the case? Should have to go back to his place again? Plz help me out as I am bit tense with all these?
